Recent Changes to the Motor Carrier Act Exemption (March 2009 Teleconference)

In August 2005, the Safe, Accountable, Flexible, Efficient Transportation Equity Act: A Legacy for Users (SAFETEA-LU) repealed the Motor Carrier Act (MCA) exemption to the Fair Labor Standards Act (FLSA) for drivers of trucks weighing below 10,000 pounds.  In the 2008 SAFETEA-LU amendments, however, the MCA exemption was reinstated for a one-year period if the employer can show it did not have actual knowledge of the previous year's SAFETEA-LU change.
