The Institute's National Litigation Strategy Project is devoted to combating inequality and injustice in the workplace.
The National Litigation Strategy Project will include:
writing amicus curiae ("friend-of-the court") briefs in cases challenging unfair and/or unequal employment practices and laws;
initiating impact litigation in "test cases" seeking to expand workers' rights;
developing model litigation materials for significant issues affecting the ability of individuals to vindicate their workplace rights;
publishing “white papers” about legal strategies to address obstacles encountered by individuals seeking to enforce their rights in the workplace; and
providing technical assistance and support to attorneys involved in employment-related litigation on behalf of workers.
Working in conjunction with The National Employment Lawyers Association, The Institute conducted a survey of NELA members in April 2010 to find out more about the obstacles employee rights lawyers confront in summary judgment. The information gathered will assist the NLSP in developing approaches to combat the abuse of this procedural device by defendant-employers.
